Intestacy Rules

Below is a visualisation of the intestacy rules as they currently stand, so you can see, in simple terms, what will happen to your estate.

Intestacy - No Will

Notes: The intestacy rules do not recognise 'unmarried partners' and no provision is made. Children includes natural, adopted, and illegitimate (subject to proof) but excludes stepchildren. If any child predeceases leaving children then those children take equally the amount that the parent would have received if he/she had survived. The value of the family home if owned by the deceased is included in the surviving spouse entitlements of up to £200,000 and £450,000 referred to in the above chart. Where a spouse enjoys a life interest, they retain the interest earned by the capital but cannot access the capital or spend it. There is an option available to convert this to a one-off fixed sum, calculated by a rigid formula, which may be beneficial. The rules are different in Scotland and Northern Ireland.
